This shipping policy applies to all products shipped by Headlands Ventures, LLC, doing business as Mike’s Bikes. (“Mike’s Bikes), including without limitation products purchased on or through the Mike’s Bikes website at www.mikesbikes.com. Throughout this policy, the terms “we”, “us” and “our” refer to Mike’s Bikes. Mike’s Bikes offers shipping to you subject to and conditioned upon your acceptance of all terms, conditions, policies and notices stated here. If you do not accept this shipping policy, you may not proceed with having any products shipped to you from Mike’s Bikes.
Domestic Shipping
We offer free FedEx ground shipping for orders above $99+ within the contiguous US. If you live outside of the contiguous US or would like to have your order expedited, please contact us directly at info@mikesbikes.com for an accurate shipping quote.
*Some exclusions apply: cargo bikes, tandem bikes, and wire bead tires do not qualify for free shipping due to size. Cannondale, Santa Cruz, Cervelo, Gazelle, Pivot, and *other bikes ship for FREE, but there will be a $79 Wheelsmith Gold Label Assembly added at checkout (reg. $100) to cover the professional bike build and re-packaging by our certified Wheelsmith technicians.
Please note that some items may be subject to additional shipping and handling charges because of size and weight. If this is the case with your order, we will notify you first for your approval.
In-Store Pick Up
Orders requesting in-store pickup will be notified (phone, email, or text) when the item is ready at the location specified. Unless special arrangements are made in advance, orders requesting in-store pickup need to be picked up within 10 days or a 10% restocking fee will be charged.
Backorders
Occasionally, some items are unexpectedly out of stock or unavailable and may be backordered. If this should occur on an order with multiple items, we may split the shipment. The total shipping charge for orders split into multiple shipments will not exceed the amount quoted on original order.
Prices and Information
We make every effort to maintain current, accurate prices and information in our on-line catalog. We appreciate your understanding should any of the prices or other information provided be incorrect and regret any inconvenience such mistakes may create. Please bring any errors you may find to our attention on your next visit or by calling or sending us an e-mail. 1. The stated purchase price per product does not include the shipping costs. If the product ordered by the customer is delivered abroad in accordance with the contract and if customs duties become due and/or customs clearance costs are incurred as a result, these shall be paid by the customer.
Assembly
Bicycles with Gold Label Assembly are fully assembled and adjusted by technicians at our distribution center prior to shipment. Certain components (wheels, seat posts, pedals, handlebars) are disassembled for transport. As a result, the customer must assemble these on the bicycle after receipt of the bicycle with the aid of the information and tools supplied and the videos provided by us in part on our website or, if necessary, by contacting telephone support at (866) 600-BIKE.
We recommend having all products assembled and serviced by skilled professionals with the necessary experience, tools and equipment. We further recommend following all manufacturer’s user manuals when assembling, using, maintaining, and servicing such products. FAILURE TO PROPERLY ASSEMBLE, USE, MAINTAIN OR SERVICE PRODUCTS PURCHASED ON THE SITE MAY RESULT IN SERIOUS PERSONAL INJURIES OR DEATH TO YOU AND/OR THIRD PARTIES AS WELL AS EXTENSIVE PROPERTY DAMAGE. WE ARE NOT RESPONSIBLE FOR CLAIMS OR LOSSES ARISING FROM ASSEMBLY, USE, MAINTENANCE OR SERVICE OF PRODUCTS PURCHASED ON THE SITE OR OTHERWISE FROM MIKE’S BIKES BY YOU OR ANY THIRD PARTY. THE FOREGOING EXPRESSLY INCLUDES, WITHOUT LIMITATION, ASSEMBLY, MAINTENANCE, OR SERVICE PROVIDED BY A SERVICE PROVIDER RECOMMENDED OR APPROVED BY US. ANY SUCH RECOMMENDATIONS OR APPROVALS ARE PROVIDED AS AN ACCOMMODATION AND WE NEITHER ACCEPT NOR ASSUME ANY LIABILITY FOR THE CONDUCT OF ANY SUCH SERVICE PROVIDER, EVEN IF YOU WOULD NOT HAVE OTHERWISE FOUND THE SERVICE PROVIDER. USE OF ANY RECOMMENDED OR APPROVED SERVICE PROVIDER IS AT YOUR SOLE RISK.
Disclaimer of Warranties; Limitation of Liability. ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE OR OTHERWISE FROM MIKE’S BIKES ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. The applicable product manufacturer may offer an express limited warranty, in which case compliance with the warranty is the manufacturer’s responsibility.
In no case shall Mike’s Bikes, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service or the site or otherwise from Mike’s Bikes, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Assumption of Risk; Liability Release
You fully understand and acknowledge that: (a) BICYCLING AND RELATED ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH TO YOU AND THIRD PARTIES AS WELL AS PROPERTY DAMAGE TO YOU AND THIRD PARTIES (“Risks”), WHICH RISKS CAN BE INCREASED IN THE EVENT OF IMPROPER ASSEMBLY, USE, MAINTENANCE, OR SERVICE OF RELATED PRODUCTS; (b) these Risks and dangers are inherent in bicycling and related activities and may be caused by your own actions or inactions, the actions or inactions of others, or the conditions in which the activities take place; and (c) there may be other risks and social and economic losses either not known to you or not readily foreseeable at this time. YOU FULLY ACCEPT AND KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I INCURRED AS A RESULT OF YOUR PURCHASE, OWNERSHIP, ASSEMBLY, MAINTENANCE, SERVICE, AND USE OF PRODUCTS PURCHASED ON THE SITE OR OTHERWISE PROCURED FROM MIKE’S BIKES AND PARTICIPATION IN RELATED ACTIVITIES, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, PSYCHOLOGICAL INJURY, PAIN, SUFFERING, DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS ARISING FROM ENGAGING IN SUCH ACTIVITIES, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF MIKE’S BIKES OR OTHERWISE.
To the maximum extent allowed under applicable law, you hereby release, discharge, and covenant not to sue, each of Mike’s Bikes and its owners, affiliates, administrators, directors, agents, officers, members, volunteers, and employees, and each of their respective successors and assigns (each a “Releasee”) from any and all liabilities, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the purchase, ownership, assembly, maintenance, service, or use of any products on the site or otherwise from Mike’s Bikes or participation in any related activities, including any of the foregoing arising from the negligence or other wrongful conduct of any Releasee or otherwise, or from the breach of any representation or warranty given by you or from the interpretation or construction of these Terms of Service (collectively, “Claims”). You further covenant not to make or bring any such Claim against any Releasee and, if for any reason the foregoing covenant not to sue is not enforced or respected, or if any third party should bring a Claim against any Releasee, to indemnify, defend, and hold harmless each of the Releasees from any and all litigation expenses, attorneys’ fees, losses, liabilities, damages, and costs which any Releasee may incur as the result of any such Claim. You understand that by accepting the foregoing liability waiver and indemnity agreement, you are waiving any and all Claims of any kind, including those Claims that may be unknown to you or which you do not suspect to exist at this time. Some jurisdictions do not allow the full and complete release and waiver of claims set forth above, so some of the foregoing provisions may not apply to you.
Governing Law; Jurisdiction and Venue
This shipping policy and all claims arising from it (including without limitation your use of the site and/or your purchase, use, assembly, maintenance, or service of any products purchased on or through the site or otherwise procured from Mike’s Bikes) shall be governed by the internal laws of the State of California (United States of America) without regard to its conflict of laws doctrine and without application of rules favoring the non-drafting party. Jurisdiction and venue for any and all claims arising from this Agreement, regardless of legal theory, shall be in California Superior Court sitting in Marin County, California. If any such action is removed to federal court for any reason, jurisdiction and venue shall be in the United District Court for the Ninth Circuit (Northern District of California) sitting in San Francisco, California. You consent to the jurisdiction of the foregoing courts and waive all objections to venue therein.
